ViralYuk Responsibilities

1. ViralYuk offers a partner listing, services, and promotion, between the user, the merchants and other vendors and does not accept any liability arising out of your purchase experience regarding quality of service, as it is delivered by a partner and not by ViralYuk.
2. Unless stated otherwise, ViralYuk is only displaying content, deals and promotions as entered or stated by partners. ViralYuk is not responsible for those deals mentioned and/or advertised on its website or Mobile Application. Deals and promotions that a partner may offer are governed solely by the respective partner’s policies.
3. Without omitting the above-mentioned Article, ViralYuk shall hold no responsibility to:
   1. the content displayed or posted by any other party except such content displayed or posted by ViralYuk itself on the website and/or Application including but not limited to photos, comments, spam, price forecasts or rating. Should inappropriate photos, or content is being displayed, ViralYuk will give its best endeavors to remove them;
   2. partners’ failure to honor the order made or created under ViralYuk’s website and/or Application. Should you find a partner fails to honor the purchase made through ViralYuk, you have to inform ViralYuk. We shall try our best to resolve the issue. Should you have a complaint, we assure you to take up the matter with the partner concerned on receipt of complete details.
4. We do not endorse or promote any partners. We may prioritize some partners in our listings based on their promotional campaigns, but ViralYuk does not accept any liability for any of these promotions by the said partners. You will be solely responsible for your decision to purchase at the promoted partners. ViralYuk is only a media to display such partner deals without any responsibility of ViralYuk.

Accessing and Downloading the Application from the App Store / Play Store

• The following apply to any ViralYuk application (each, a “Mobile Application”) sourced through the Apple, Inc. (“Apple”) App Store (“App Store”) or through Google, Inc (“Google”) Play Store (“Play Store”):

1. You will use any Application sourced through the App Store only: (i) on an Apple-branded product that runs iOS (Apple’s proprietary operating system software); and (ii) as permitted by the “Usage Rules” set forth in the App Store Terms of Service. You will use any Application sourced through the Play Store only: (i) on a product / device that runs Android; and (ii) as permitted by the “Usage Rules” set forth in the Play Store Terms of Service.
2. You acknowledge and agree that: (i) this Agreement is between you and ViralYuk only, and that Apple/Google is not a party to this Agreement; and (ii) ViralYuk, not Apple/Google, is solely responsible for any Application sourced through the App Store or Play Store and the content thereof.
3. If sourced through the App Store, you will only use the Application in connection with an Apple device that you own or control. If sourced through the Play Store, you will only use the Application in connection with an Android powered device that you own or control.
4. You acknowledge and agree that Apple/Google has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.
5. In the event of any failure of the Application to conform to any applicable warranty, including those implied by law, you may notify Apple/Google of such failure; upon notification, Apple’s/Google’s sole warranty obligation to you will be to refund to you the purchase price, if any, of the Application to the maximum extent allowed by law. As between ViralYuk and Apple/Google, any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be the sole responsibility of ViralYuk.
6. You acknowledge and agree that, as between ViralYuk and Apple/Google, Apple/Google is not responsible for addressing any claims you have or any claims of any third party relating to the Application sourced from the App Store or Play Store or your possession and use of the Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.
7. You acknowledge and agree that, in the event of any third party claim that the Application sourced from the App Store or Play Store or your possession and use of that Application infringes that third party’s intellectual property rights, as between ViralYuk and Apple/Google, ViralYuk, not Apple/Google, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim to the extent required by this Agreement.
8. You acknowledge and agree that Apple/Google, and Apple’s/Google’s subsidiaries, are third party beneficiaries of this Agreement as related to your license of the Application sourced through the App Store or Play Store, and that, upon your acceptance of the terms and conditions of this Agreement, Apple/Google will have the right (and will be deemed to have accepted the right) to enforce this Agreement as related to your license of the Application against you as a third party beneficiary thereof.
9. Without limiting any other terms of this Agreement, you must comply with all applicable third party terms of agreement when using the Application sourced from the App Store/Play Store.

User Communication Guidelines

1. We send our users (registered with us) regular communications about our products and offers.
2. Any activity related to user wallet transactions will also be communicated to customers via SMS, email and Push.
3. Users can send us email to remove them from marketing communications. However, they will always get messages related to bookings, wallet transactions.

Termination and Changes

• ViralYuk reserves the right to suspend accounts if we notice any activity that we believe is abusive, fraudulent, or in violation of our Terms of Service.

User Agreement to Policies

1. ViralYuk provides a service between users and partners and has no control or right over specific partner policies.
2. All users will have to agree and adhere to the policies set by the partners that they dine at.
3. These policies include but are not limited to; child policy, legal age of entry and legal drinking age.

Sharing on ViralYuk

1. Users are prohibited from posting or transmitting any defamatory, obscene, pornographic, profane, threatening or unlawful material or any content that could constitute or encourage conduct that would be considered a criminal offense or harm minors, contain software virus, give rise to civil liability, or otherwise violate any law.
2. ViralYuk assumes no responsibility arising from the contents of any communications containing any such material.
3. ViralYuk reserves the right to change, edit or remove any user material or conversations that are illegal, indecent or violate ViralYuk’s policy.
4. ViralYuk will fully cooperate with any law enforcement authorities or court order requesting or directing ViralYuk to disclose the identity of anyone posting such remarks.

Copyright Policies

1. ViralYuk reserves the right to change these conditions from time to time as it sees fit and your continued use of the site will signify your acceptance of any adjustment to these terms.
